§ 1. Service Provider and contact details
- The pobyto.pl website (the Website) is operated by Easy Legal spółka z ograniczoną odpowiedzialnością (a limited liability company) with its registered office at: ul. Belgradzka 10A, Gdańsk, entered in the register of entrepreneurs of the National Court Register (Krajowy Rejestr Sądowy) kept by Sąd Rejonowy Gdańsk-Północ w Gdańsku, VII Wydział Gospodarczy KRS under KRS number 0000970955, NIP 5842817438 (the Service Provider).
- Contact with the Service Provider: e-mail [email protected], telephone +48 506 579 045 (calls charged at the Client's operator rates), correspondence address the same as the registered office address.
- The Service Provider may also communicate with the Client on an ongoing basis via instant messaging apps (e.g. Telegram, WhatsApp), if the Client chooses such a channel. The Client may always submit statements with legal effect (in particular withdrawal from the agreement, termination and complaints) by e-mail or in writing to the Service Provider's address.
- The Website is not a public administration portal. The Service Provider is not the authority conducting the proceedings for granting a residence permit and has no influence on the content or timing of the decision.
§ 2. Definitions
- Client — a natural person, legal person or organisational unit that sends an Enquiry or concludes an Agreement with the Service Provider.
- Consumer — a Client who is a natural person concluding an Agreement not directly related to their business or professional activity; the provisions concerning Consumers also apply to a natural person concluding an agreement directly related to their business activity, where the content of the agreement shows that it is not of a professional nature for that person.
- Enquiry — a message sent via the Form on the Website, by telephone or by e-mail, in which the Client asks to be contacted and to be presented with the scope and price of assistance.
- Form — the contact form available on the Website.
- Package — a scope of the Service defined on the Website and offered at the stated price: "Residence permit based on work", "Family residence permit" or "Application document preparation".
- Service — organisational and documentation assistance provided by the Service Provider in a residence permit matter, within the scope of the selected Package.
- Agreement — an agreement for the provision of the Service concluded at a distance on the terms set out in § 5.
- Durable medium (trwały nośnik) — a material or tool that enables information to be stored in a way that allows access to it in the future and its unchanged reproduction, in particular an e-mail message with a PDF attachment.
- MOS — Moduł Obsługi Spraw (Case Handling Module), the ICT system for submitting applications in matters concerning foreigners.
§ 3. Services provided electronically
- On the Website, the Service Provider makes available free of charge: (a) information about the Packages and prices, (b) the Form enabling an Enquiry to be sent.
- To use the Website you need: a device with Internet access, an up-to-date web browser with JavaScript enabled and — in order to receive a reply — an active telephone number or e-mail address. The Website does not require creating an account.
- The agreement for the service of browsing the Website is concluded when the page is opened and terminates when it is left. The agreement concerning the Form is concluded when the Enquiry is sent and expires when a reply is given or when the Client withdraws, which the Client may do at any time.
- The Client is prohibited from providing unlawful content, in particular data of third parties without a legal basis and content infringing personal rights.
- Information about health, criminal record or other specially protected data should not be entered in the comment field of the Form.
- Using the Internet involves risks such as malware, phishing or interception of data on unsecured networks. The Service Provider uses an encrypted connection (HTTPS). The Service Provider never asks for logins, passwords, SMS codes or access to the Trusted Profile (Profil Zaufany) or the MOS account.
- Sending an Enquiry is not placing an order and does not create an obligation to pay.
§ 4. Scope of the Services and their limits
- The detailed scope of each Package, what is included in it and what is not included in it are described on the Package pages on the Website and are confirmed in the offer sent to the Client before the Agreement is concluded.
- The "Residence permit based on work" and "Family residence permit" Packages include in particular: determining, on the basis of information from the Client, which type of permit the Client may apply for, preparing an individual list of documents, verifying the documents provided, preparing the application data and attachments, support with handling the application in MOS, and assistance with correspondence in the same proceedings until a decision is issued by the first-instance authority.
- The "Application document preparation" Package includes an individual list of documents, verification of the set of documents provided, preparation of the data and the application form, and a list of missing items together with instructions for submitting the application yourself. The Package ends with these materials being handed over to the Client; the Client submits the application and conducts further correspondence independently.
- Each Package concerns one set of proceedings for one person (applicant). Each family member is a separate applicant.
- Unless the parties agree otherwise on a Durable medium, the Services do not include: appeals and complaints, complaints to administrative courts and representation before courts, a new application or a change of the basis of stay, sworn translations, personal assistance at the office, official fees (including the stamp duty (opłata skarbowa) for the permit, for issuing the residence card and for the power of attorney) or any other external costs.
- The Service Provider undertakes to act with due diligence, not to achieve a particular result. Only the competent authority (in particular the voivode (wojewoda)) decides on granting the permit, its content and timing. The Service Provider does not guarantee a positive decision or a decision within a specific time.
- The Service Provider does not provide legal assistance reserved for advocates (adwokaci) and legal advisers (radcowie prawni) and does not represent Clients before courts. If the matter requires this, the Service Provider informs the Client.
- The Client signs the application in MOS personally (e.g. with a Trusted Profile, a personal signature or a qualified signature). When summoned by the authority, the Client appears in person, in particular to have fingerprints taken and to present original documents.
- If the Agreement provides for acting as a representative (pełnomocnik) in administrative proceedings, the representative is the natural person cooperating with the Service Provider indicated in the Agreement. The power of attorney is granted in writing, and the stamp duty on the power of attorney is borne by the Client, unless the Agreement provides otherwise.
§ 5. Conclusion of the Agreement
- The Client sends an Enquiry. The Service Provider contacts the Client by telephone or e-mail, establishes the Client's situation and proposes a Package.
- Before the Agreement is concluded, the Service Provider sends the Client an offer by e-mail containing: a description of the Package and its scope, the price, deadlines, the division of the Service into stages (§ 7(4)), these Terms of Service, the Privacy Policy, information on the right of withdrawal (Annex 1) and the model withdrawal form (Annex 2).
- The Agreement is concluded when the Client confirms acceptance of the offer on a Durable medium, in particular by replying to the e-mail with the offer. A statement made only orally during a telephone call does not result in the conclusion of the Agreement.
- Immediately after the Agreement is concluded, and at the latest before the provision of the Service begins, the Service Provider sends the Client confirmation of the conclusion of the Agreement on a Durable medium.
- If the Service Provider calls the Client, it states its business name and the purpose of the call at the beginning of the conversation.
§ 6. Price and payments
- The Package prices stated on the Website are final prices for the Client per applicant and include all applicable taxes. The price binding on the parties is the one stated in the offer accepted by the Client.
- The price does not include the costs listed in § 4(5). The Service Provider informs about them before the Agreement is concluded.
- Payment is made by bank transfer to the Service Provider's bank account indicated in the confirmation of the conclusion of the Agreement, within the time limit and in the instalments specified in the Agreement. The Service Provider issues a sales document in accordance with the law.
- The Service Provider does not use personalised prices based on automated decision-making. In the event of a price reduction, the Service Provider also states the lowest price that applied during the 30 days before the reduction.
§ 7. Performance of the Service
- The Service Provider begins providing the Service after 14 days from the conclusion of the Agreement. At the express request of the Consumer, made on a Durable medium (Annex 3), the Service Provider begins providing it earlier.
- Deadlines for preparing materials are agreed in the offer and run from the day on which the Client provides the complete set of information and documents requested by the Service Provider.
- The Client undertakes to: provide true and complete information and documents, inform about any change in their situation (in particular employment, address, marital status, document expiry dates), respond on time to the Service Provider's requests and to letters from the authority, and appear in person when required by the authority. The Service Provider is not liable for the consequences of the Client providing untrue or incomplete information or for delays resulting from the Client's lack of cooperation.
- For settlements in the event of withdrawal from or termination of the Agreement, the following division of the value of the full-handling Packages (work, family) applies, unless the Agreement provides otherwise: stage 1 — analysis of the situation and individual list of documents: 25%; stage 2 — verification of the documents provided: 25%; stage 3 — preparation of the application data and attachments: 30%; stage 4 — support with MOS and correspondence until the decision: 20%. For the "Application document preparation" Package: stage 1 — list of documents: 30%; stage 2 — verification of the set of documents: 30%; stage 3 — application data and form, and instructions: 40%.
- The Service Provider stores copies of the Client's documents only to the extent and for the time necessary to perform the Service, in accordance with the Privacy Policy. The Service Provider does not accept or store criminal record certificates or information about the Client's criminal record.
§ 8. Right of withdrawal from the Agreement
- A Consumer who has concluded an Agreement at a distance may withdraw from it without giving any reason within 14 days from the day of its conclusion.
- To withdraw, it is sufficient to send an unequivocal statement before the deadline expires, e.g. by e-mail to [email protected] or by letter to the Service Provider's address. The model form (Annex 2) may be used, but this is not obligatory. The Service Provider promptly confirms receipt of the statement on a Durable medium.
- In the event of withdrawal, the Service Provider refunds all payments received promptly, no later than 14 days from the day of receipt of the statement, using the same method of payment as used by the Consumer, unless the Consumer agrees to another method that involves no costs for them.
- If, at the Consumer's request (§ 7(1)), the Service Provider began providing the Service before the withdrawal period expired, a Consumer who withdraws from the Agreement is obliged to pay for the services performed up to the time of withdrawal. The amount is calculated in proportion to the scope of the services performed, taking into account the price set out in the Agreement and the division in § 7(4).
- The right of withdrawal does not apply if the Service Provider has fully performed the Service with the express prior consent of the Consumer, who was informed before the start of the service that they would lose the right to withdraw from the Agreement once the Service Provider has performed the service, and acknowledged this.
§ 9. Termination of the Agreement
- The Client may terminate the Agreement at any time, including after the withdrawal period has expired. In that case, the Client pays for the work performed up to the time of termination, determined in accordance with § 7(4), and the Service Provider refunds the remaining part of the price paid within 14 days.
- The Service Provider may terminate the Agreement for important reasons, which are exclusively: the Client providing documents or information that the Client knew to be untrue; a request for actions contrary to the law; no contact from the Client for 30 days despite two requests sent on a Durable medium. The Service Provider settles accounts with the Client on the terms set out in paragraph 1.
§ 10. Complaints
- The Client may submit a complaint concerning the Website or the Service by e-mail to [email protected] or in writing to the Service Provider's address.
- The complaint should contain the Client's contact details, a description of the problem and the expected way of resolving it. Missing information does not result in the complaint being rejected; the Service Provider may ask for it to be supplemented.
- The Service Provider considers the complaint within 14 days of receiving it and sends its reply on a Durable medium. Failure to reply within this time limit means that the Consumer's complaint has been accepted.
- If the Consumer's complaint is not accepted, the Service Provider will state in its reply whether it agrees to out-of-court dispute resolution.
§ 11. Out-of-court dispute resolution
- A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular: the assistance of the municipal or district consumer ombudsman (rzecznik konsumentów); mediation or the permanent consumer arbitration court at the Voivodeship Inspectorate of the Trade Inspection (Inspekcja Handlowa); entities entered in the register kept by the President of the Office of Competition and Consumer Protection (Prezes UOKiK).
- Information about these methods is available at prawakonsumenta.uokik.gov.pl. A Consumer resident in another European Union country may ask the European Consumer Centre for assistance.
- Using out-of-court methods is voluntary and requires the consent of both parties.
§ 12. Liability
- The Service Provider is liable to the Client on the general terms of civil law for non-performance or improper performance of the Agreement, exercising the diligence required by the professional nature of its activity.
- Towards Clients who are not Consumers, the Service Provider's liability is limited to the amount of the remuneration paid under the Agreement and does not include lost profits; this limitation does not apply to damage caused intentionally.
- The provisions of these Terms of Service do not limit the Consumer's rights under mandatory provisions of law.
§ 13. Personal data
The rules for processing personal data, including the recipients of the data and its transfer outside the European Economic Area, are described in the Privacy Policy.
§ 14. Language and versions of the Terms of Service
- The Terms of Service, the offer and the Agreement are drawn up in Polish. On the Website, the Service Provider also provides translations into English, Russian and Ukrainian. In the event of discrepancies, the Polish version prevails.
- At the request of a Client who is not a Polish citizen and is fluent in a given language, after being informed of the right to a Polish version, the Agreement may be drawn up solely in a foreign language.
- The Terms of Service are made available free of charge on the Website before the Agreement is concluded in a manner that allows them to be obtained, reproduced and recorded (e.g. by saving or printing the page). On request, the Service Provider sends the Terms of Service by e-mail in PDF format.
§ 15. Amendments to the Terms of Service and final provisions
- The Service Provider may amend the Terms of Service for important reasons, which are: a change in the law, a change in the scope or manner of providing the Services, or a change in the Service Provider's details. Amendments do not apply to Agreements concluded before they enter into force.
- Matters not regulated herein are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The choice of law does not deprive the Consumer of the protection afforded by provisions that cannot be excluded by agreement.
- Disputes with Consumers are resolved by the court having jurisdiction under the general rules. Disputes with Clients who are not Consumers are resolved by the court having jurisdiction for the Service Provider's registered office.
- These Terms of Service apply from 18 October 2026.
